Huntsman’s abandoning Utah Sticks Us with What He Didn’t Want to Notice

Since 2005, advocates for fair elections with all votes counted have been trying to get Jon Huntsman’s attention, but he has always deferred to the Lt. Governor, the designated executive director of Utah Elections. Huntsman, who appeared to be a Governor of both courage and conscience when he stood up against the Divine Strake Test and in favor of Civil Unions for gays, nonetheless, kept his eyes above and his nose clean when it came to the issue of his Lt. Governor and the hackable Diebold Voting Machines we are stuck with in Utah.

While others concerns about Lt. Governor Herbert becoming Utah's governor are focused on his conservative views, the failure to even discuss Herbert's most bullying policy -- because most people are blind to it -- shows how successful the man is at misinforming and intimidating at the most important levels.

It's this simple: Lt. Governor Gary Herbert is the one person who unilaterally decided, against the advice of computer science experts, to purchase the Diebold Touch Screen Voting Machines for the State of Utah, to comply with the 2005 Help America Vote Act (HAVA), the law primarily authored by the since-imprisoned Congressman Bob Ney, under the influence of the $275,000 in funds Diebold paid in 2005 to the since-jailed-lobbyist Jack Abramoff’s company.

When Bruce Funk, the veteran Emery County Clerk, received the Diebold machines for his county and dutifully performed the “acceptance testing”, he found absurdly elementary defects that could wreak havoc on an election day: crooked paper feeds, open memory card bays, flimsy parts that got stuck or loose. A closer look brought the discovery of inexplicable anomalies in the memory cards.

A responsible election official for over twenty years, Funk had paid attention to issues of the reliability and security of these machines. He read in December 2005, Finnish computer security expert Harri Hursti and Dr. Herbert Thompson of Security Innovations, Inc. had demonstrated for Leon County, Florida election Ion Sanchez the hackability of the Diebold Optical Scan voting machines which could change election outcomes (see HBO’s documentary, Hacking Democracy, October 2006). That same day, the CEO of Diebold, who’d infamously pledged to secure Ohio for George Bush in a 2003 memo, suddenly resigned.

So, when Funk couldn't get sensible answers to his questions about the memory cards from Diebold, he contacted Bev Harris at BlackBoxVoting.org, who had arranged for the demonstration in Florida. In March 2006, Harri Hursti and Dr. Thompson from Security Innovations Inc. came to Utah to address the Bruce’s questions.

After examining two Diebold touch screen machines, documented on videotape, and a second series of testing by both Hursti and Security Innovations, Hursti explained to Funk that in addition to simplistic design flaws that presented electrical safety hazards, the machines’ architectural design included two critical security holes which enabled hacking and then efficiently covered up evidence of the hacking. Hursti’s written report was released on May 6, 2006.

But Bruce Funk didn’t wait for the report. On March 23, 2006, he courageously announced that security experts had found dangerous security flaw in the Diebold Voting machines and so he would not use the machines in Emery County.

Diebold immediately claimed their warranty contract had been violated and that it was fining Emery County $40,000 to recertify the two examined machines. Michael Cragun, Lt. Governor Herbert’s Utah Election Director, immediately ordered the locks changed on the room in which the machines were stored, so Funk was barred access to them.

Cragun quickly arranged a special closed-door meeting with the Emery County commissioners, and on March 27th flew to Emery County with the Lt. Governor’s Chief of Staff, Joe Demma, legal counsel from the Utah Attorney General’s office, and the sales rep and a technician from Diebold. Neither Funk nor the public could attend. After the meeting, Funk was ordered to use the Diebold machines, period. A comment from Funk made in frustration was taken as an irrevocable resignation and the courageous election official, himself an elected officer, was locked out.

The Lt. Governor’s Office thus intimidated Utah’s election officials and personnel into compliance and silence, regardless of what problems are witnessed. While Thad Hall from the University of Utah, with ties to the voting machine industry, argues down concerns reported in the national media about the hackability of electronic voting machines, the Utah Elections website, part of the Lieutenant Governor’s website, eliminated the word “Diebold” even before Diebold renamed itself Premiere Election Systems.
At this point, Diebold has been decertified in multiple states across the country, most notably in California, after the Secretary of State conducted an intensive multi-level testing of the machines, and found Diebold to be not only hackable, but uncooperative. In March of this year, Diebold/Premiere admitted that flaws in their machines’ audit system could result in undetectable deleted votes.

Meanwhile, Lt. Governor Herbert had most recently been in the news, before the announcement of Huntsman ambassadorship, as being unwilling to enforce the new Utah campaign contribution reporting law. He’s protecting the lobbyists – not the voters.

With Herbert in charge, the Governor’s Commission on Strengthening Utah’s Democracy, announced by Huntsman in January, will continue to keep Utahns unaware and docile. Jon, if only you’d noticed. . .

Diebold TSx not responding to Touch a "Human Problem"

At the Sprague Library in Salt Lake City, Utah. . .

Hi. I followed up on an email by Heather Bennett, a local candidate, forwarded to me explaining that one of her constituents contacted her about voting at the Sprague Library in Salt Lake City, Utah, where the Diebold TSx was having a problem with recording votes on the lower left of the screen. When I saw that there was nothing with the key words on Google News, I reported it to CNN, which then forwards you to your local county officials.

At the office of the Salt Lake County Elections, I spoke to a young lady (at 2:51 pm MDT) who left the phone for a few minutes then came back to tell me that "The machines are working fine." She got this from someone she called Scott K, a technician regularly employed by the Salt Lake County Elections office, who had been sent to the Sprague Library and he told this young lady that the machines were working fine. She also said I could call him at his phone number, 801-468-3470.

So I did. Scott told me that he'd heard that a voter was having difficulty voting, so he stopped by to see if there was an issue, but that it turned out to be a human problem, not a machine problem.

I asked if the pollworkers had been aware of the problem, and at this point Scott wanted to know if I was calling as a citizen or was I part of a group. I said I was a citizen who will post what I find out online because activist organizations across the country were asking individual citizens to get involved in reporting. We continued.

Scott said that according to the pollworkers, when the voter's vote had not registered, one of them had tried, and failed, but that they solved the problem before the voter actually finally "cast" the vote.

Scott observed a demonstration of what had happened, and he told me that for the vote attempts that did not register, they were touching the screen in a way that he wouldn't expect the screen to be responsive. They were pressing it with a wide surface of their finger, then pressing very hard.

When he heard my typing, Scott asked about it, then said he should have been told that I was doing so, but I simply asked if there was a problem with it, and continued.

Scott reiterated that this was a human problem rather than a mechanical one, that people touch things differently, and that some machines are more responsive than others.

When I interrupted to question that, he said, "Let me rephrase that." Some touches, he tried to explain, "The way people touch the screen has something to do with a machine's responsiveness."

I questioned whether this was information that the voters knew or that the pollworkers knew? Scott's response was to point out the three "feedback mechanisms" in the system that give the voters a chance to check to see if their vote was properly recorded before voting. He insisted that this was a voter problem and not a pollworker training issue. He said that a voter is usually persistent enough to handle this.

Finally, he said that he had told the pollworker that if this should happen again, the voter should be given a pencil, because an eraser head is more precise than a digit.

Then, why don't the machines have a stylus? No response.

Even NPR Finally Says So

It's been very difficult to forgive NPR for its complete lack of coverage of the hearings in Ohio held by Congressman John Conyers and the Democratic minority of the House Judiciary Committee in December 2004, immediately following the shocking reversal of Senator John Kerry's lead in the polls, the vote, and ultimately the entire Presidential election.

I especially can barely listen to Neal Conan. To understand why, history is beginning to show that his response to an apparent flood of emails seeking real news reporting and discussion seemed to be decidedly patronizing.

BUT TODAY -- MINUTES AGO -- at the top of the 11:00AM MDT hour, NPR announced that the Secretary of State of Ohio, Jennifer Brunner, has announced that ALL of the DRE electronic voting machines used in the 2004 election in Ohio were completely vulnerable to manipulation and could not be trusted.

In addition, NPR reported, this problem also applies to voting machines used in other states as well.

For example - UTAH - RIGHT HERE IN UTAH!!!! GOT IT?!!!!!!!

Those are DIEBOLD machines!!!!!!
At long last, let's all say it.

Once again I find myself typing out "Hallelujah" on the BradBlog site!

And a Happy All Saints Day it truly is!

The point of All Saints Day is to rise like the Phoenix out of fear, away from evils both real and imagined, into the Light of Truth, of Compassion, of Good, i.e. God.

And so it is, with the banning of DRE Touch Screen Voting Machines, we Americans truly experience this transformation this year.

For surely we have been living years of fear, because of evils both Real:
- Stolen elections protected by a corrupt Department of Justice
- Federal agencies handed over to corporate lobbyists, and (WORST OF ALL)
- The annihilation of the Iraqi and Afghan civilizations, as well as the sacrifice of American lives, all to feed the insatiable greed of the Oil, Weapons and Construction/Service industries)

And Imagined :
- The Bush/Cheney/Powell/Rice/Rumsfeld/Giuliani drumbeats, facilitated by the Mainstream Media in exchange for increased ownership and government contracts.

And we Americans have been more powerless than ever because our elections have been under attack. Voting machines have switched, lost and added votes, registered voters have been intimidated and/or turned away, and elections officials have unilaterally acted against the majority.

It is only by removing the corruptive elements attacking our elections, the basis of the Democracy Mr. Bush claims to be spreading, that we, as the citizens of the United States, can develop policies that reflect our Jefferson's belief in our Rights to Life, Liberty, and the Pursuit of Happiness, along with our evolved understandings about Health, Economics, and Access to Opportunity.

This Halloween, in a mood, my daughter I chose to face an artistic depection of Darkness. To this end, we went to closing night of the brilliant, haunting Sondheim musical Sweeney Todd, as performed by the Egyptian Theatre Company in Park City, Utah.

Though I know the music fairly well, and have seen it before both on the video and in a large theater, this time, in an intimate theater, with a brilliant cast, and with years now of never-ending horrific realizations discovered in my study of the Bush administration, I literally shuddered on Sweeney's final look back at the audience and door slam.

Now that we have seen Sweeney Todd and the world he inhabits, what will we do?

For there are universal truths present in the story of Sweeney Todd:

1. Justice decided by those who use their Power for selfish gain brings Ruin to Family, Individual Sanity, Society, and ultimately Itself.

2. A Society where Industry becomes Supreme is Filthy and Corrupt, and ultimately Selfdestructive (cannibalistic), where previously decent people become Heartless Profiteers.

3. The only way to burst through the degradation of such a world is for good people to pay attention, to hear each other, and to work towards Shining the Light for All to See, so we can recognize the Crimes, stop them, and hold the perpetrators accountable. Thus there is a Redemption of honest and fair Justice.

Sounds timely, eh?

So -- Now -- let's use this open window that Senators Bill Nelson (D-FL) and Sheldon Whitehouse (D-RI) have provided, and that Brad Friedman (bradblog.com) has diligently reported.

The Time Has Come

The time has come, Democracy said, to talk of many things:
Of Diebold, Funk, Ohio’s Ney,
Of Abramoff buying kings–
And why HAVA cannot matter–
Since the warnings that Hursti brings.
Okay, no more beating around the Bush – now Utah’s Emery County Clerk, Bruce Funk, is redeemed.

Perhaps you’ve heard of him. His March 23rd announcement that he would not use the Diebold voting machines Lt. Governor Herbert sent him caused an emergency closed-door meeting on March 27th with Diebold, the Emery County Commissioners and Counsel, and Michael Cragun, Elections official from Lt. Governor Herbert’s office – but not Funk.

When the doors were finally opened, Funk was told to use the Diebold machines. Unwilling to accept responsibility for their security, he threw it back on the Commissioners, who later insisted that was his resignation.

This all happened after the March 18 posting at http://www.blackboxvoting.com/ of an initial independent evaluation of Diebold’s TSx by Harri Hursti, Finnish computer security expert, and Security Innovation (consultant to Symantec, McAfee and Microsoft), based on their examination of two of Funk’s 40 machines, at his request.

For that, Diebold punished Emery County with a $40,000 fine. Yet none of this was reported by Michael Cragun on April 19, before the State Government Operations Interim Committee, updating the legislature about the voting machines implementation, with Bruce Funk seated nearby.

But last week, the official report from Hursti/Security Innovation is out, again at http://www.blackboxvoting.org/BBVtsxstudy.pdf, detailing "multiple backdoors built into the system", and Bruce is mentioned, with great respect. (Additional concerns will be addressed in a second part to the report, expected to be out by May 16.)

The weekend before, Brad Friedman of BradBlog.com, the uniquely diligent investigative blogger, reported that early word on Hursti’s report prompted Pennsylvania voting system examiner Dr. Michael Shamos to force acknowledgement of the problems out of Diebold. Pennsylvania Secretary of State Pedro Cortez then issued a Security Alert for the Diebold machines and a lock down of the equipment before this week’s primary.

The jig is up. Diebold machines, currently creating chaos in primaries, allow voting results to be altered – easily, quickly and undetectably, without passwords.

For several years, computer scientists have warned the technology isn’t ready yet, especially because the vendors’ work harder at securing large contracts than securing election integrity.
Those large contracts have been prompted by HAVA, the Help America Vote Act. Notice it isn’t called the Help America’s Votes Get Counted Act.

In fact, Congressman Bob Ney, of recent Abramoff infamy, was a co-sponsor and author of HAVA, just when Diebold paid $275,000 to Abramoff at Greenberg & Traurig, to push for electronic voting machines in HAVA – with no verifiable paper trail. Meanwhile, Diebold donated heavily to The National Federation of the Blind, pushing accessibility before security.
Compliance with HAVA may be impossible, requiring the disabled to have "the same opportunity for access and participation (including privacy and independence) as for other voters".

Ponder this: Can a voting system that serves individuals who are blind, also serve those who are deaf, as well as those in wheelchairs, and with dexterity issues? – And without assistance with no chance of someone seeing their votes.

So, HAVA was written with absurd standards by a corrupt Congressman, under the influence of cash from a corrupt lobbyist, paid by Diebold, a company that corruptly sold uncertified software to California for the 2004 election (and settled out of court for $2.6 million), whose machines are revealed to be corruptible – with Bush’s most important election, legacy-wise, only months away.

New York State has demanded and received postponement of its HAVA compliance from the Department of Justice. Utah needs to do the same.

Bruce Funk is an American Hero

Mr. Bruce Funk, Emery County Clerk, should be thanked, not attacked, and his story told accurately.

Bruce Funk is a responsible elected official who has paid attention to problems in other states, he recognized the danger to democracy if we depend on the accuracy of machines that break down easily or can be hacked into, altering votes. That is why he brought in the Finnish computer security specialist Harri Hursti, and an expert from Security Innovation, Inc., a company whose clients include McAffee Security, Symantec Security, the Department of Defense, and Microsoft to examine the Diebold TSx voting machines that his county had been required to purchase by the state of Utah.

Currently, there is an effort to strong-arm Mr. Funk out of office. Last week, following Mr. Funk's announcement that he would not use the Diebold machines, Lt. Governor Herbert's Chief of Staff Demma, Utah elections officer Cragun and legal counsel from Utah Attorney General's office flew into Emery, accompanied by a representative and a tech man from Diebold who threatened the county with punitive actions for testing their equipment.

No one seemed concerned that the integrity of Utah voting is at risk.
The Utah State officials, along with the County Sheriff, County Commissioners, and County Attorney - and Diebold representatives - met behind closed doors - especially closed to Funk - and then told him they were sticking with Diebold. When he told them he was not comfortable with this decision, he was told he should consider retiring. Exhausted and fed up, Funk agreed to think about it for May 1 or June 1, but they pushed for April 1, paid through June 1. Funk said he'd sleep on it. That's all.

The next morning the County claimed that Bruce Funk had resigned, which he immediately denied. When I called there on Friday, I was told, rather gruffly, that Bruce Funk resigned in a public meeting (I guess they call it that because after their private meeting they opened the doors to tell Funk their decisions), and that his resignation is in the minutes to be posted after the next meeting!

Bruce Funk is not the first victim of Diebold's punitive response to being hacked. In December, Ion Sanchez of Leon County, Florida also filmed a demonstration of a mock election in which 2 "yes" and 6 "no" votes on a Diebold were altered by Security Innovation hackers from a short distance to 7 "yes" and 1 "no". That same day the infamous Republican Ranger CEO and Chairman of Diebold promptly resigned.

Since then, Ion Sancho has been blacklisted by the voting machine companies which refused to furnish machines in time for upcoming elections. A rally of support and evidence of the companies' collaboration has resulted in the announcement this week of the Florida Attorney General's investigation into Diebold Election Systems, Inc., Election Systems & Software, Inc., and Sequoia Voting Systems, Inc., their marketing, and their joint refusal to sell to Leon County.

Meanwhile, Maryland and New Mexico are moving away from touchscreen voting machines, and primaries in Illinois and Texas have revealed lost tabulation memory cards and impossible totals. Evidence is building nationwide that these private corporate voting machines will lead to more questionable elections, false mandates, and leaders who do whatever they want.

That is not what this country is supposed to be.

Know Bush Fact #25

On April 24, 2003, while promoting his tax plan, Bush stopped in Canton, Ohio at the Timken Company, a Fortune 500 company, with 2003 sales of $3.8 billion, to speak before the workers at its steel ball-bearing manufacturing plant:

"The greatest strength of the American economy is found right here, right in this room, found in the pride and skill of the American work force. . . Here at Timken, last year, productivity rose 10 percent. Which means that America can compete with any nation in the world because we got the finest workers in the world."

On May 17, 2004, century-old Timken Company announced it was closing the doors to three of its ball-bearing plants in Canton, laying off 1,300 employees.

Timken President James W. Griffith tried to blame the closure on the United Steel Workers of America, but union President Stan Jasionowski said the USWA and Timken were not in any kind of contract negotiations. The union was blindsided by Timken's decision.

Timken’s ball-bearing production will be moved. It is timely that two new Timken NSK ball-bearing plants in China began production in January, and the Randleman, North Carolina plant failed to unionize in February.

W.R. "Tim" Timken, Chairman of the Board of Timken Company, whose decision it was to close the plants, earned more than $2.6 million last year, and stands to receive $59,000 in new tax breaks from Bush this year.

By contrast, 89% of Ohio residents will receive less than $100 by 2006 from the latest Bush tax cuts.

Last summer, Timken co-hosted a fundraiser for Bush's campaign which raised $600,000, and earned Timken "Ranger" status in Bush’s multi-level marketing donation pyramid structure.

W.R. Timken was signed in as the Bush-appointed Chairman of the Board of the Securities Investor Protection Corporation on April 22, 2003 (2 days before Bush’s speech at his plant), and is also a long-time Director of Diebold, Inc., manufacturer of the highly controversial electronic voting machines.

A final note: In December 2003, Mr. Timken hosted a $2,000-per-person fundraiser, where he spoke before featured guest Vice President Dick Cheney and an audience of Ohio's wealthiest business and civic leaders. Timken denounced liberal philanthropist Peter Lewis’s multi-million dollar pledge to partially match donations to MoveOn.org’s voter fund campaign as an "attempt to buy democracy."

Meanwhile, the Gannett News Service reported that the Cincinnati, Ohio zip code 45243 ranks second only to New York City's 10021 as the most lucrative fundraising neighborhood for Bush, surpassing wealthy communities in Houston, Dallas and even Beverly Hills.
